This Privacy Policy explains how Evergreen Comply, LLC, doing business as DQ File Management, collects, uses, shares, and protects information when you visit our site, create an account, manage a carrier workspace, submit or review driver qualification materials, upload documents, sign records, receive reminders, or otherwise use the Services.

Our role

  • For many driver qualification workflows, the carrier, employer, or partner using the Services decides what information to collect, why it is collected, how long it should be retained, and who may access it. In those cases, we act as a service provider or processor for that customer.
  • For account administration, site operations, security, support, billing, analytics, legal compliance, and our own business operations, we may act as an independent controller or business under applicable privacy laws.
  • Drivers and applicants should contact the carrier, employer, or partner that requested their information for employment, qualification, correction, deletion, or record-retention questions tied to a driver file.

Information we collect

  • Account and contact information, including names, emails, phone numbers, company details, carrier details, and user roles.
  • Driver qualification and application information, including driver contact details, dates of birth, address history, employment history, license information, medical qualification data, drug-and-alcohol policy acknowledgements, consents, attestations, and signatures.
  • Compliance records and uploaded documents, including MVR-related records, PSP/FCRA/Clearinghouse-related records, prior-employer investigation materials, certificates, policy documents, rosters, internal notes, and supporting files.
  • Usage, audit, and device information, including timestamps, IP addresses, browser and device data, user agents, document activity, signature events, upload events, and workflow status changes.
  • Communications and support information, including email, SMS, phone, and support messages related to application, upload, signature, onboarding, and account workflows.

How we use information

  • Provide, operate, secure, troubleshoot, and improve the Services.
  • Create and manage carrier workspaces, driver files, application links, checklist items, document requests, signature requests, reminders, and exports.
  • Store, scan, classify, extract, organize, display, transmit, and attach documents where needed to provide the Services.
  • Send operational email, SMS, phone, and in-app communications for accounts, applications, secure uploads, signatures, reminders, service notices, and support.
  • Maintain audit records, enforce terms, prevent fraud or abuse, and comply with legal obligations.

How we share information

  • With authorized users in the applicable partner, carrier, or customer workspace.
  • With service providers that help us provide hosting, storage, databases, authentication, email, SMS, analytics, document scanning, malware scanning, customer support, and similar operations.
  • When required by law, legal process, regulators, disputes, security investigations, or to protect rights, safety, and platform integrity.
  • In connection with a merger, acquisition, financing, restructuring, or sale of assets, subject to appropriate protections.

Sensitive information

  • Driver qualification workflows may involve sensitive personal information, including government identifiers where collected, medical qualification information, drug-and-alcohol program records, background-screening authorizations, employment history, licensing records, signatures, and compliance attestations.
  • We use sensitive information only to provide the Services, maintain security, satisfy legal obligations, follow customer instructions, or as otherwise permitted by law. We do not use sensitive driver data for cross-context behavioral advertising.

Your choices and rights

  • You may contact us to request access, correction, deletion, or other rights available under applicable law.
  • Operational emails may be necessary to provide the Services. Marketing emails, if any, include unsubscribe options.
  • SMS messages are operational and compliance-related, not marketing. Reply STOP to opt out of SMS and HELP for help.
  • Customers and carriers control many driver-file records and may need to handle driver requests directly under their own legal obligations.
  • Depending on your location, you may have rights to know, access, correct, delete, port, restrict, or object to certain processing, and to appeal or complain to a regulator. We will verify requests as required by law.

Subprocessors and transfers

  • We use vendors and subprocessors for cloud hosting, databases, storage, authentication, email, SMS, analytics, malware scanning, document processing, support, and other operational services.
  • Information may be processed in the United States and other countries where we or our vendors operate. Where required, we use appropriate contractual or legal safeguards for cross-border processing.

Retention and security

We keep information as needed to provide the Services, follow customer instructions, support compliance recordkeeping, resolve disputes, secure the platform, and satisfy legal obligations. We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the data, but no transmission or storage method is completely secure.

Driver qualification records may be retained for periods required by customers, regulators, contracts, litigation holds, backups, security logs, and legal obligations. Deletion requests may be limited where retention is legally required or where the customer controls the record.

Security incidents

If we determine that a security incident requires notice, we will notify affected customers or users as required by applicable law and our contractual obligations.

Children

The Services are intended for business, employment, and compliance workflows. They are not directed to children under 13, and we do not knowingly collect personal information from children under 13.

Changes to this policy

We may update this Privacy Policy from time to time. Material changes may be posted, communicated, or presented for renewed acknowledgement where appropriate.
